Personally Identifiable Information is any information about you that you have provided to us including but not limited to the following: Name, Date of Birth, Gender, Nationality, Home Address, Email Address, Debit/Credit Card or any Payment Method Information and other relevant information.
We automatically receive and record technical and usage information on our server logs such as your Internet Protocol (IP) address, unique hardware identifiers such as MAC Address and other similar information, your browser type, browser language, referring and exit URLs (including, without limitation, your access to third party sites (including through links, advertisements, or other means), including social networks such as Twitter, Facebook, and Google+), interactions with other users, usage statistics with the Services, and device identification information regarding the computers, the servers or other devices with which you use our Services.

For your security, we reserve the right to contact you to confirm and verify your request to edit Personal Information, including the right to request additional information to confirm your identity and that you have the right to edit Personal Information tagged to a particular account. - Applications you use or download from the Sites may contain third party digital rights management systems ("DRMS") which may allow for communication between your software and the third party and utilize security features (e.g., preventing distribution of or access to the applications in the event of unauthorized use). These DRMS are subject to their own license agreements and you agree that PlayPark shall not be responsible for any loss or damage of any sort relating to the use of the DRMS or your dealings with such third parties. The Applications may also contain DRMS produced by PlayPark which allow for communication between the applications you use or download and our systems and which collect information describing your computer system in order to prevent illegal or unauthorized use of the applications.

COPYRIGHTS AND TRADEMARKS

EXCEPT AS EXPRESSLY PROVIDED HEREIN BY THESE TERMS, NEITHER PLAYPARK, ITS AFFILIATES, NOR ANY THIRD PARTY HAS CONFERRED UPON YOU BY IMPLICATION, ESTOPPEL OR OTHERWISE, ANY LICENSE OR RIGHT UNDER ANY PATENT, TRADEMARK, COPYRIGHT OR OTHER PROPRIETARY RIGHTS TO USE THE SITE OR ANY APPLICATIONS OFFERED ON THE SITE. NO OWNERSHIP RIGHTS ARE OR WILL BE ASSIGNED TO YOU.

IN ADDITION, PLAYPARK DISCLAIMS ANY WARRANTIES OF NON-INFRINGEMENT, TITLE OR QUIET ENJOYMENT IN CONNECTION WITH THE SITE, APPLICATIONS, AND RELATED INFORMATION.

ASSUMPTION OF RISKS

YOU ASSUME ALL RISKS THAT THE SITE, APPLICATIONS, AND RELATED INFORMATION ARE SUITABLE OR ACCURATE FOR YOUR NEEDS AND WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. ANY APPLICATIONS DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SITE ARE AT YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR LOSS OF DATA. BY PARTICIPATING IN MULTI-PLAYER GAMES OR VISITING CHAT ROOMS YOU MAY BE EXPOSED TO RUDE, CRUDE, INDECENT, OR OTHER OFFENSIVE LANGUAGE OR REFERENCES. YOU AGREE THAT PLAYPARK SHALL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE OF ANY SORT RELATING TO YOUR DEALINGS WITH ANY THIRD PARTY ADVERTISER OR CONTENT PROVIDER ON THE SITE.

NO INCIDENTAL, CONSEQUENTIAL OR CERTAIN OTHER DAMAGES

TO THE MAXIMUM EXTENT ALLOWED BY LAW, YOU AGREE THAT NEITHER PLAYPARK NOR ANY OF PLAYPARK'S AFFILIATES OR AGENTS WILL BE LIABLE TO YOU AND/OR ANY OTHER PERSON FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF PRIVACY OR FOR FAILURE TO MEET ANY DUTY INCLUDING BUT NOT LIMITED TO ANY DUTY OF GOOD FAITH, LACK OF NEGLIGENCE OR OF WORKMANLIKE EFFORT) OR ANY OTHER INDIRECT, SPECIAL, OR PUNITIVE DAMAGES WHATSOEVER THAT ARISE OUT OF OR ARE RELATED TO THE SITE, APPLICATIONS OR RELATED INFORMATION, OR TO ANY BREACH OF THESE TERMS, EVEN IF PLAYPARK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IN THE EVENT OF FAULT, TORT (INCLUDING NEGLIGENCE) OR STRICT OR PRODUCT LIABILITY.

LIMITATION OF LIABILITY AND EXCLUSIVE REMEDY

YOU AGREE THAT YOUR SOLE REMEDY FOR ANY BREACH OF THESE TERMS BY PLAYPARK OR ANY OF PLAYPARK'S AFFILIATES OR AGENTS SHALL BE, AT PLAYPARK'S OPTION,
- SUBSTITUTION OR REPLACEMENT OF ALL OR PART OF THE APPLICATION OR PRODUCT THAT GIVES RISE TO DAMAGES INCURRED BY YOU IN REASONABLE RELIANCE ON PLAYPARK;
- REFUND OF THE AMOUNT THAT YOU PAID TO PLAYPARK. YOU AGREE THAT THE DAMAGE EXCLUSIONS IN THESE TERMS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

YOUR REPRESENTATIONS AND WARRANTIES

You represent and warrant for the benefit of PlayPark, PlayPark's suppliers, and any third parties mentioned on the Site, in addition to other representations and obligations contained in these Terms, that:
- SUBSTITUTION OR REPLACEMENT OF ALL OR PART OF THE APPLICATION OR PRODUCT THAT GIVES RISE TO DAMAGES INCURRED BY YOU IN REASONABLE RELIANCE ON PLAYPARK;
  - you possess the legal right and ability to enter into and make the representations and warranties contained in these Terms;
  - all information submitted by you to the Site is true and accurate;
  - you will keep your registration information current;
  - you will be responsible for all use of your password even if such use was conducted without your authority or permission;
  - you will not use the Site for any purpose that is unlawful or prohibited by these Terms;
  - you are the owner of the Materials and they are original to you;
  - the Materials do not infringe any third party right, such as copyright, trademark, and publicity/privacy right;
  - the Materials do not constitute defamation or libel or otherwise violate the law, and
  - you agree to defend, indemnify, and hold PlayPark (and its employees, representative, agents, and assigns) harmless from breaches of (12-1) through (12-8).

LINKS; ADVERTISERS

The Site contains links to third party sites that are not under the control of PlayPark and PlayPark is not responsible for any content on any linked site. If you access a third party site from the Site, then you do so at your own risk. PlayPark provides links only as a convenience and the inclusion of the link does not imply that PlayPark endorses or accepts any responsibility for the content on those third party sites. Additionally, your dealings with or participation in promotions of advertisers found on the Site, including payment and delivery of goods, and any other terms (such as warranties) are solely between you and such advertisers. You agree that PlayPark shall not be responsible for any loss or damage of any sort relating to your de alings with such advertisers.

OWNERSHIP

The Site, Applications, and related information are the exclusive property of PlayPark or its suppliers. All rights not licensed herein are hereby reserved to PlayPark or its suppliers.

TERMINATION OR CANCELLATION OF SITE ACCESS; MODIFICATIONS TO SITE AND APPLICATIONS

If you violate these Terms, PlayPark may terminate or cancel your access rights to the Site and/or Applications immediately without notice. PlayPark may also block your use of the Site and/or Applications or direct you to cease using it. PlayPark reserves the right at any time to modify or discontinue the Site, Applications, or any part thereof and you agree that PlayPark shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Site, Applications, or any part thereof, except you may receive a pro-rata refund in the event such modification, suspension, or discontinuance materially affects your access to those parts of the Site or Applications that you have paid for.

ENTIRE AGREEMENT

These Terms, as amended, your registration forms, and the disclosures provided by PlayPark and the consents provided by you, constitute the entire agreement between you and PlayPark. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. Asiasoft's failure to act with respect to a breach by you or others does not waive Asiasoft's right to act with respect to subsequent or similar breaches.

PROTECTION OF PERSONAL INFORMATION

PlayPark may use, collect and/or disclose your personal information that is necessary to verify your identity, process your account, analyse your preferences and inform you of upcoming promotions or events organised or co-organised by PLAYPARK.
PlayPark may disclose your personal information to third party service providers in connection with the above, where necessary, under a duty of confidentiality to PlayPark.
You may access and/or correct your personal information by logging-in to your account
PlayPark may update you with information such as promotions, launch of new products and special events via direct mails, emails and text messages.
If you do not wish to receive our marketing mails, emails and text messages, If you do not wish to receive our marketing mails, emails and text messages, you may opt out at any time by managing your preferences from your MapleStorySEA Passport Account.

Email Address Collection and Usage Policy – MSPassport/Playpark

1. Introduction

This policy outlines how MSPassport ("the Portal") collects, uses, stores, protects, and manages email addresses provided by its members. We are committed to protecting the privacy and security of our members' personal information, including their email addresses, in compliance with applicable data protection laws and best practices.

2. Scope

This policy applies to all email addresses collected from members through their registration, usage, or interaction with MSPassport. It also applies to all employees, contractors, and third parties who, in the course of performing their duties or providing services to MSPassport / PlayPark may have access to such email address data. This Policy applies regardless of the geographic location of the member, the location of our servers, or the country from which the Portal is accessed.

3. Collection of Email Addresses

Voluntary Provision: Email addresses are primarily collected when members voluntarily provide them during the registration process for an account on the Portal or when participating in Portal’s activities, campaigns, or promotions that require an email address for eligibility, communication, or fulfilment purposes.
Account Management: Email addresses may also be collected or updated when members manage their account settings or interact with specific features requiring an email for verification or communication or when contacting Portal’s customer support or service channels.
Consent: By registering and providing an email address, members explicitly consent to the collection and usage of their email address in accordance with this policy and represent and warrant that the email address provided is accurate, valid, and owned or lawfully controlled by them. The Portal shall be entitled to assume, without any obligation to verify or investigate, that any email address submitted is provided by the true and lawful owner thereof. Any email address submitted that is not owned or authorised by the true owner is provided at the member’s sole risk, and the Portal shall not be responsible or liable for any loss, damage, or dispute arising therefrom.

4. Purpose of Collection and Usage

Email addresses are collected and used for the following primary purposes:

Account Creation and Management: To create and maintain member accounts, facilitate login, password resets, and account-related notifications.
Essential Communications: To send important service announcements, terms of service updates, privacy policy changes, and security alerts directly related to the member's use of the Portal.
Transactional Communications: To send notifications related to specific actions taken by the member on the Portal (e.g., confirmation of a forum post, notification of a new message, order confirmations if applicable), and other communications reasonably arising from the member’s interactions with the Portal
Reward Delivery: To send rewards such as ItemCodes to eligible members or winners of events and campaigns conducted by MSPassport/PlayPark, and to administer loyalty, incentive, or similar benefit programmes.
Customer Support: To respond to member inquiries, provide technical support, and address issues or feedback.
Optional Marketing Communications (with consent): With explicit opt-in consent, email addresses may be used to send newsletters, promotional offers, updates about new features, or other marketing materials from MSPassport/PlayPark or its carefully selected partners. Members will always have the option to opt-out of these communications.
Security and Fraud Prevention: To verify identity, detect and prevent fraudulent activities, and enhance the security of member accounts and the Portal.
Analytics and Improvement: To analyze usage patterns, improve the functionality and user experience of the Portal, and develop new features. This is typically done with aggregated or anonymized data where possible.
Other Related Purposes: For any other purposes reasonably necessary or incidental to the operation, administration, protection or improvement of the Portal and its related services, or as otherwise notified to members from time to time in accordance with applicable law (including, where required, with the member’s consent).

5. Data Storage and Security

Secure Storage: Email addresses are stored on secure servers with appropriate technical and organizational measures to protect against unauthorized access, disclosure, alteration, or destruction.
Encryption: Email addresses and other sensitive data are encrypted both in transit and at rest where feasible and appropriate.
Access Control: Access to email address data is strictly limited to authorized personnel who require it for the performance of their duties, and who are bound by confidentiality obligations.
Data Retention: Email addresses will be retained for as long as a member maintains an active account on the Portal, and for a reasonable period thereafter as required by law or for legitimate business purposes (e.g., audit trails, dispute resolution). Upon account closure, email addresses will be anonymized or securely deleted, unless required to be retained by law.

6. Sharing of Email Addresses

No Sale of Data: We will never sell, rent, or lease member email addresses to third parties for their independent marketing purposes without explicit consent. For the avoidance of doubt, this does not prevent the sharing / transfer of email address data in connection with a permitted business transfer as described below.
Affiliates and Group Companies: We may share email addresses with our parent company, subsidiaries, and other affiliated or related entities within the same corporate group, to the extent reasonably necessary for the operation, administration, support, improvement, or promotion of the Portal and related services, subject to this Policy and applicable law.
Service Providers: We may share email addresses with trusted third-party service providers who assist us in operating the Portal, providing services, or conducting our business (e.g., email delivery services, customer support platforms, hosting providers). These service providers are contractually bound to protect the confidentiality and security of the data and are prohibited from using email addresses for any purpose other than providing the services to us.
Legal Compliance: We may disclose email addresses if required to do so by law, court order, or governmental authority, or if we believe in good faith that such action is necessary to comply with legal obligations, respond to lawful requests, protect our rights or property, investigate or prevent fraud, security or technical issues, or ensure the safety of our members or the public.
Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, member email addresses may be transferred as part of the transaction. Members will be notified of any such change of ownership or control.

7. Member Rights and Choices

Members have the following rights regarding their email addresses:

Access and Correction: Members can access and update their email address and other account information through their Portal profile settings.
Opt-Out of Marketing Communications: Members can opt-out of receiving marketing communications at any time by clicking the "unsubscribe" link in the email or by adjusting their notification preferences in their account profile settings. Please note that even if you opt-out of marketing emails, we may still send you essential service-related communications. Changes related to opting out of receiving marketing emails may take up to 7 (seven) working days to take effect due to the processing of ongoing campaigns. Where the delivery of marketing communications is handled by third-party service providers, the Portal shall, within seven (7) working days of receiving the opt-out request, notify the relevant service provider to effect such opt-out. The member acknowledges and agrees that the Portal does not control the internal processing timelines of such third-party service providers and that a reasonable delay may therefore occur. The Portal shall not be responsible or liable for any such delay beyond its reasonable control.
Opt-Out on External Systems: Opting out of receiving emails from PlayPark / Portal in systems not within MSPassport may affect our ability to send you emails which may include rewards or prizes. The Portal shall not be responsible or liable for any loss or consequence arising from such non-delivery.
Account Deletion: MapleStorySEA Passport accounts and all game accounts contained within cannot be deleted once they have been created due to server policy restrictions, limitations and for legal or legitimate business purposes as outlined in Section 5. We can only suspend the whole account permanently and wipe your registered personal particulars if you do not wish to continue playing our games and using our services. All unique particulars registered to the account such as LoginIDs and 13-digit PassportIDs cannot be re-used to recreate other accounts.
Withdraw Consent: Members can withdraw their consent for the processing of their email address at any time, although this may affect their ability to use certain features of the Portal.

8. Children's Privacy

MSPassport is not intended for use by individuals under the age of 6. We do not knowingly collect email addresses or other personal information from children without verifiable parental consent. If we become aware that we have inadvertently collected personal information from a child without proper consent, we will take steps to delete that information.

9. Changes to this Policy

We may update this policy from time to time to reflect changes in our practices or legal requirements. Members will be notified of any material changes to this policy through their registered email address or prominent notice on the Portal. Continued use of the Portal after such notification constitutes acceptance of the updated policy.
